Offers and prices
Prices shown on www.atelierpopulaire.fr (the “Website”) are stated in euros, including all taxes but excluding shipping charges (see Delivery). Prices may change during the year. Products ordered (the “Product” or “Products”) are invoiced at the prices in force when the order is registered.
Orders
The steps for placing an order are as follows:
- Select the item or items you wish to purchase and add them to your basket. You may check the contents of your basket and the corresponding price, and make any necessary changes, at any time.
- Sign in using your email address and password. If you are a new customer, you must create an account and identify yourself by entering a valid email address and a personal, confidential password, which you will subsequently use to sign in to the Website.
- Choose and confirm your delivery method, then choose and confirm one of the payment methods offered. You must provide the personal information needed to process and deliver your order.
- To confirm your order, you must read these terms and conditions and accept them by ticking the box “I have read the terms and conditions of sale and accept them without reservation”. When you confirm your order by clicking the “Confirm and pay for the order” button, you declare your acceptance of it.
- Once your order has been registered, a detailed acknowledgement will be sent to your email address. It summarises all the elements of your order, including the exact amount charged and your delivery arrangements.
- Once payment has been received, your order is confirmed and processed by our team.
We nevertheless reserve the right to cancel any order from a customer with whom there is a dispute concerning payment for an earlier order, or for any other legitimate reason, including an abnormal order.
Product availability
Our offers of Atelier Populaire products are valid only while stocks last. If a product becomes unavailable after you place an order, we undertake to inform you within 8 days and tell you how long you will need to wait to receive it. If you wish, you may request cancellation, with reimbursement by bank transfer within 14 days, or an exchange of your order by contacting [email protected].
Payment
Purchases on the Website must be paid for exclusively in euros. All payments are made by bank card. The card is normally charged when the order is placed. Online card payment is fully secure.
Delivery
Our prices are for dispatch from Paris, France, and exclude delivery charges. Products are delivered in mainland France to the address you select in the order form, within an average of 2 working days after confirmation of the order (see the Orders section above). For deliveries abroad and to French overseas departments and territories, the average delivery time is 5 working days after confirmation of the order. You are responsible for providing all the accurate information necessary for your order to be delivered correctly.
Right of withdrawal
If the Product does not meet your expectations, you may exercise your right of withdrawal from the time your order is registered and within 14 clear days starting on the day after receipt. To do so, send a withdrawal request to [email protected], then return the Product in its original packaging and in perfect condition to: Service Client Atelier Populaire, 134 rue d'Aubervilliers, 75019 Paris, France. Include your name and the order number shown on the order acknowledgement.
We undertake to exchange the Product for a similar product or, failing that, a product from an equivalent range. If you prefer, we will refund it by cheque within 14 days of your withdrawal request, subject to our receipt of the Product under the following conditions:
- The Product must be returned complete, in its original packaging and in perfect condition, within 14 days of your withdrawal request. The buyer bears the cost of the parcel and shipping.
- If the Product is returned for a reason for which we are responsible, we will reimburse the Product, shipping charges and any return costs.
Product guarantee
Atelier Populaire products benefit from the statutory guarantee against hidden defects in delivered products. The guarantee for Atelier Populaire products is limited to replacement of products considered defective, excluding any other compensation.
To invoke the Product guarantee, send a request to [email protected], then return the Product at your expense, in its original packaging and in perfect condition, to: Service Client Atelier Populaire, 134 rue d'Aubervilliers, 75019 Paris, France.
Liability
The products offered comply with the French legislation in force on the date of sale. Atelier Populaire cannot be held liable for damage resulting from use of Atelier Populaire products that does not comply with the instructions supplied with them.
Atelier Populaire cannot be held liable for failure to perform the contract in the event of stock shortages or product unavailability, force majeure, disruption or a total or partial strike, particularly affecting postal services, transport and/or communications.
Atelier Populaire accepts no liability for indirect damage arising, in particular, from use of the Product, such as operating losses, loss of profit, loss of opportunity or other damage or costs.
Atelier Populaire notes that, under Article 1124 of the French Civil Code, unemancipated minors do not have capacity to enter into contracts. Orders intended for minors must therefore be placed by a person with parental authority. If personal data relating to a minor is collected accidentally, the person with parental authority may object to its retention and/or disclosure to third parties.
Hyperlinks may lead to websites other than this Website. Atelier Populaire accepts no liability if the content of those websites contravenes applicable laws and regulations.
Intellectual property
Under the laws governing literary and artistic property and other similar rights, the Website and all its elements, trademarks, designs, models, logos, graphics and other content, together with their compilation, are the exclusive property of Atelier Populaire or its suppliers. They grant no licence or other right beyond the right to view the Website.
Reproduction or use of all or part of these elements is authorised solely for information purposes for personal and private use. Any reproduction or use of copies for other purposes is expressly prohibited. Any other use constitutes infringement and is punishable under the French Intellectual Property Code, unless Atelier Populaire has given prior written permission.
Applicable law and jurisdiction
This contract is governed by French law. The language of this contract is French. In the event of a dispute, the French courts shall have exclusive jurisdiction.
Changes to the terms and conditions of sale
In view of possible changes to the Website, Atelier Populaire reserves the right to adapt or amend these terms and conditions of sale at any time. Any new terms and conditions will be brought to customers' attention through an online update and will apply only to sales made after the amendment.
